Liberal leader John Pesutto will push ahead with plans to expel a controversial MP from the party despite her threats to sue him.
Moira Deeming has issued a defamation concerns notice to Pesutto's office less than 24 hours before a vote to decide her fate.
The notice, which comes after Deeming on Saturday claimed she "never once considered suing the Liberal Party", demands John Pesutto withdraw the motion which could banish Deeming to Victoria's parliamentary crossbench.

It also demands he publish an apology on his website, and pay Deeming compensation and her legal costs or risk legal action in the Federal Court.
A spokesperson for the Liberal leader confirmed, "Pesutto had received a letter from Deeming foreshadowing legal proceedings".
"As the matter is likely to be before the courts, he will not make any further comment," the spokesperson said.
Despite the threat, tomorrow's vote will proceed as planned.
Pesutto believes he has the numbers to expel Moira Deeming from his parliamentary Liberal party properly this time.
Deeming survived a similar motion in March but was suspended from the party for nine months over her role in organising a Let Women Speak rally which was crashed by neo-Nazis who performed the Nazi salute.

That rally has been described by Deeming as a women's rights demonstration.
Her opponents have criticised it as an anti-trans demonstration.
Pesutto compiled a dossier of evidence against Deeming after that rally, and took issue with her interacting with activist Kelly Jay Keen; another women's rights activist who has featured in videos with YouTubers who have separately shared their platform with members of the KKK.
Deeming has been demanding Pesutto issue an apology, opposing any suggestion that she is herself a Nazi or affiliated with Nazis.
Pesutto denies ever making that allegation.
